Personal Injury FAQ

The most common personal injury questions we get.
  • How long do I have to file a personal injury claim?

In Virginia, the deadline (also known as the “statute of limitations”) to file a claim is two years. In Louisiana, the statute of limitations is only one year. However, in some cases, you may have a longer or shorter time frame depending on the circumstances. For instance, if you are filing a claim against a government agency, you likely have less time to submit your claim. The deadline for maritime cases varies depending on the type of claim. It is always best to initiate your claim as soon as possible just in case, especially because evidence is easier to collect just after an accident.

  • What damages are available in personal injury cases?

Because every personal injury claim is different, what damages are available to you will depend on the specific losses you have suffered. However, personal injury damages typically include compensation for medical expenses, lost wages, property damage, pain and suffering. Funeral and burial expenses, as well as other costs, will likely be awarded in the event of wrongful death. Since each case is unique, the exact amount of compensation a client receives changes case by case. As your lawyer, Charles Rothermel will fight to secure the maximum amount of compensation available to you.

  • How long will it take to resolve my claim?

Unfortunately, the duration of a case also depends on a number of factors, such as how cooperative the defendant (person or entity you are suing) is, how much in assets they possess, how much evidence you have to support your claim, and how effective your attorney is. If your case goes to court, it could take even longer to resolve; however, approximately 90% of personal injury claims settle before trial. Due to the number of factors that affect it, the duration of your case could fall anywhere between several weeks to a couple of years. Fortunately, by speaking directly to a lawyer about your case you should be able to get a rough idea of how long your specific matter will take to resolve.

  • Do I need to hire a lawyer to resolve my case?

While an attorney is not required to file a claim, hiring a legal professional can make the legal process run far smoother and produce more effective results. If your case is very straightforward and/or you have legal knowledge or experience of your own, you may choose to tackle the case yourself. However, we recommend at least consulting with an experienced personal injury attorney to help you determine the scope of your claim and whether a lawyer would be beneficial or not. Ultimately, the choice is entirely up to you.
