How long do I have to file a personal injury claim?
In Virginia, the deadline (also known as the “statute of limitations”) to file a claim is two years. In Louisiana, the statute of limitations is only one year. However, in some cases, you may have a longer or shorter time frame depending on the circumstances. For instance, if you are filing a claim against a government agency, you likely have less time to submit your claim. The deadline for maritime cases varies depending on the type of claim. It is always best to initiate your claim as soon as possible just in case, especially because evidence is easier to collect just after an accident.
What damages are available in personal injury cases?
Because every personal injury claim is different, what damages are available to you will depend on the specific losses you have suffered. However, personal injury damages typically include compensation for medical expenses, lost wages, property damage, pain and suffering. Funeral and burial expenses, as well as other costs, will likely be awarded in the event of wrongful death. Since each case is unique, the exact amount of compensation a client receives changes case by case. How long will it take to resolve my claim?
